In the following terms and conditions, the “photographer” is Ingrid Remisova or Ingrid Remisova Photography. The “client” is a person or organization using the photographer’s services and the “shoot” is a photography shoot offering services and products agreed between the client and the photographer in a contract. A “contract” is a written or spoken mutual agreement between the client and the photographer.

These terms & conditions cannot be varied in any way by the client unless such conditions are expressly agreed by the photographer in writing.

pre-shoot consultation

If included in the contract, the client is entitled to a pre-shoot consultation to discuss any ideas and needs they may have for the photographer to ensure that adequate services are provided.

payment schedule / fees

The client agrees to pay the photographer a non-refundable initial payment (session/booking fee) upon signing the contract to confirm the booking and secure the date. The session/booking fee will be deducted from the total fee.

The remaining balance is due to be paid no later than on the day of the photo delivery. If the fee is unpaid, the photographer reserves the right to withhold any services, images and merchandise. If the client cancels the shoot for any reason, the booking fee will not be returned to the client.

The photographer must deliver the photos in a reasonable amount of time after the client has made the final order. The client understands and agrees that prints (if required) take longer for delivery.

All fees are non-refundable if the shoot is cancelled by the client. All cancellations must be in writing.

location permits

The client is responsible for acquiring all permits and necessary permission for all locations on which the photographer is performing services. The photographer has no duty to obtain permission from reception centres, buildings, properties, or other locations to operate thereon. The client understands and agrees that if any failure to obtain these permissions results in fines to the photographer, or prevents the photographer from photographing the session, is not the fault, liability, or responsibility of the photographer. The photographer is limited by the rules and guidelines of the location(s) and site management.

The photographer provides coverage for the dates, locations and continuous hours specified in the contract. Additional travel or coverage hours may be added by agreement on the day and must be paid in full before any photos or products are released to the client. The photographer will use her professional judgment and sole discretion to select which photos to deliver. Photographs taken during the event will be at the discretion of the photographer although every effort will be made to comply with the client’s requirements.

schedule and cooperation

Both the client and the photographer agree that punctuality and cooperation are essential to accomplishing the goals and wishes of all parties within the understanding of this contract. Shooting commences at the scheduled start time and ends at the scheduled end time.

post-production and editing

All final post-production and editing styles, effects and overall look of the images are left to the discretion of the photographer. The client may request further changes for an additional charge.

Prints are produced by the photographer per a request if not included in the agreed package. The photographer is not responsible for any prints that are not ordered directly from her. However, for best results, the photographer recommends that the client should order the prints through a reputable lab using the high-resolution files provided by the photographer.

All images will be fully edited and enhanced, portraits will be lightly retouched. Any advanced retouching, digital manipulation and artist finishing is available to the client as an option at an extra cost.

The photographer will deliver proofs of photos, if required, and finalised photos to the client within a timeframe specified in the contract. The client understands and agrees that proofs are the exclusive property of the photographer and the client has no right to use the photos except for a license to review them, but not store the proofs. Finalised, high (for print) and small (for web) resolution photographs provided by the photographer will be delivered within the timeframe specified in the contract.

use / licence

Images are to be used as agreed at the time of booking. All photos delivered to the client are licensed for the client’s use and period as specified in the contract. The usage rights granted are personal to the client and may not be assigned, nor may any image submitted to the client be loaned or transferred to third parties, if not previously agreed otherwise. The photographer reserves the right to refuse to supply or grant a reproduction licence to a third party when requested to do so by the client. The photographer shall be granted artistic licence in relation to the poses photographed and the locations used.

The following terms are used when describing the licence granted by the photographer:

Non-Commercial Rights – the right to use images for personal websites, blogs, school newsletters, and other media where images will not be explicitly used as a part of a for-profit/money-making activity.

Commercial Rights – the right to use images for commercial purposes in communications designed to sell their products or services such as a catalogue, brochure, or on some other form of advertisement.

One Time Use Rights – the right to use images one time only, for one specific purpose to the client as described in the contract.

All rights are non-exclusive rights of use unless agreed otherwise in the contract.

The client agrees and understands that no other party other than the photographer may take pictures of any poses, lighting situations, or setups made by the photographer. This slows down the photographer’s work and violates the photographer’s right to take pictures of the event. The client agrees to take responsibility for insisting that no person(s) hinder the photographer or take pictures in these situations.

The copyright of photographs always remains with the photographer. See the copyright section for more details.

All client’s details will be stored on a private database. These details will not be made public or shared with any companies or individuals.

model release / display

The client grants permission to the photographer to assign, license and sublicense, permission to use the client’s image or likeness in any or all forms of media for commercial purposes, advertising, trade, personal use or any other use. The photographer may use the client’s likeness and image on the photographer’s website or other advertising, display any photographs included in this contract in her studio, web site, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows, unless expressly denied in writing by the client.

The photographer is not responsible for compromised coverage due to causes beyond the control of the photographer including but not limited to lateness of the client, weather conditions, schedule complications, incorrect addresses provided, rendering of decorations, or restrictions of the locations.

travel and food

Mileage is inclusive within a 30-mile radius of TW8. Events taking place outside of this 30-mile radius will be charged at 0.50p per mile. Package will incur an additional charge to cover parking, taxi’s, etc if deemed necessary. The photographer does not require that the client provides her with a meal, although expects that the client will allow her a break during the shoot.

The photographer reserves the right to terminate coverage and leave the location of the events if inappropriate, threatening, hostile or offensive behaviour is experienced from person(s) at the shoot. The photographer cannot be held responsible for any personal accidents during a photographic shoot. The client agrees to indemnify and hold harmless the photographer for any liability, damage, or loss related to technological failure, including data loss. The client understands and agrees that the photographer is not required to maintain copies of the photos from the shoot 90 days after the photos have been delivered to the client. The client agrees to hold the photographer harmless for any personal injury which may occur as the client poses or works with the photographer.

If for any reason the photographer is unable to provide the photographic services detailed in the contract due to unforeseen circumstances, she will do her best to find another photographer to replace her. If no replacement can be found, a re-booking will be offered. In the unlikely event that the digital files have been lost, stolen, or destroyed for reasons beyond the photographer’s control, including but not limited to the camera, hard drive, or equipment malfunction, the photographer’s liability is limited to the return of all payments received for the shoot.
